ADSCRM – Terms of Use

This Agreement (“Agreement”) establishes the terms and conditions governing your use of ADSCRM (“Service”) provided by ADSENGINE MEDIA. By accessing and utilizing the Service, you are agreeing to comply with the terms outlined in this Agreement. If you do not agree to the terms, do not proceed or use ADSCRM in any manner.

Acceptance of the Agreement

To accept this Agreement, you must be of legal age to enter into a binding agreement. If you do not agree with these terms, please refrain from using the Service.

Description of Service

ADSCRM offers lead management services for personal, business, or internal organizational purposes. Your responsibility includes obtaining internet access and necessary equipment.

Beta Service

Certain services may be provided as Beta Services for testing. The duration of testing and the decision to offer Beta Services commercially lies solely with ADSCRM. No obligation is imposed to subscribe to paid services due to Beta Service usage.

Software License and Rights

During the term of the subscription, the client is granted a non-transferable, non-exclusive license for the specified operating system, web server, and associated software. This license is limited to the use of the software in its object code form exclusively for internal purposes, and only on the provided hardware in conjunction with the services rendered. The client is strictly prohibited from making copies of the software, engaging in de-compilation, disassembly, modification, or any attempts to derive source code from the software. Furthermore, the client is explicitly forbidden from selling, leasing, licensing, transferring, providing possession, or sub-licensing the software or its accompanying documentation to any third party. The client is also prohibited from developing derivative software programs, whether in whole or in part, based on the provided software or any confidential information.

Free Trial

If you register for a free trial, it is accessible until the trial period concludes, the paid subscription begins, or termination. Any data entered during the trial may be lost unless you purchase a subscription or export data before the trial concludes.

User Sign-Up Obligations

Accurate information is required during sign-up, and it should be promptly updated. For organizational purposes, it is recommended to use your corporate email. Providing misleading information may result in account termination.

Restrictions on Use

Prohibitions encompass unauthorized transfer, disassembly, attempts at unauthorized access, and usage for competitive purposes. Additionally, using the Service for prohibited activities or threatening public order is strictly forbidden.

Our support hours are from 10:00 AM to 6:00 PM IST, Monday through Saturday, excluding public holidays and other listed holidays.

Spamming and Illegal Activities

The Service should not be used for illegal purposes, transmitting unlawful material, or engaging in spamming activities. ADSCRM reserves the right to terminate access for unauthorized or illegal activities.

Usage Limits for ADSCRM

ADSCRM may prescribe usage limits based on the subscription plan chosen by you. You must make sure that your usage is within the usage limits prescribed by ADSCRM in order to avail uninterrupted service. You understand that ADSCRM may restrict an activity if you reach the usage limit corresponding to such activity.

Organization Accounts and Administrators

For organizational accounts, administrators are recommended to manage the account. You are responsible for the confidentiality and recovery of administrator accounts.

Personal Information and Privacy

Personal information is governed by ADSCRM’s Privacy Policy . You are responsible for account security and agree to inform ADSCRM of any unauthorized use.

Communications from ADSCRM

Service-related communications are part of using the Service. While newsletters may be opted out of, service announcements cannot.

Mobile App Disclaimer

Please note that ADSCRM does not offer a mobile app as part of its services. The web application is designed for use on web browsers and may not be optimized for mobile devices. Clients are advised to access the CRM through supported web browsers for the best user experience. By opting for additional custom development services, clients acknowledge and agree to the associated charges, payment terms, and the absence of a mobile app in ADSCRM’s service offerings.

New Functions and Version Updates

Any new functions or version updates beyond the originally provided features of the CRM will be considered chargeable, requiring a one-time payment for access. These additional features may include enhancements, improvements, or new functionalities introduced in subsequent releases.

Custom Functions Exclusion

It is important to note that custom functions specifically tailored to individual client needs are not covered within the standard services. Customization requests that go beyond the existing framework of the CRM will be subject to separate agreements and charges.

Clients interested in acquiring new functions or version updates are advised to contact ADSCRM for information regarding associated costs and payment details. Custom function requests will be considered on a case-by-case basis, and clients will be provided with separate quotations for such bespoke developments.

Storage Limitation and Add-On Services

The storage limit for the use of ADSCRM is considered an add-on service, and users are required to purchase additional storage based on their specific requirements. Prices for these storage packages are detailed on the storage page of the CRM platform.

Pricing Packages

The prices for additional storage are structured according to specific packages outlined on the storage page. Users can choose the package that best aligns with their storage needs and requirements. It is essential to review the available packages and associated prices before making a purchase.

For any inquiries or assistance regarding storage add-on services, users are encouraged to refer to the information provided on the storage page or contact our customer support team for further clarification.

Intellectual Property

All rights to the theme, style, and other components of ADSCRM are reserved by ADSENGINE MEDIA. The Service is designed for bulk bookings, and any unauthorized use, reproduction, or distribution of the application or its components is strictly prohibited.

Privacy and Cancellation Policies

Clients are encouraged to review our Privacy Policy and Cancellation Policy, which outline how personal information is handled and the procedures for canceling services.

Refund Policy

Refunds are available under the following conditions:

If the services are not delivered as promised.
If a technical issue persists and is not resolved as committed in the Service functions.
No refunds or cancellations are possible once the user starts using the Service.

Complaints:

User complaints will be forwarded, and a timely response is required. Failure to respond may lead to the disclosure of user information to complainants.

Grievance Redressal:

Inactive User Accounts Policy:

Inactive accounts may be terminated after 30 days, with prior notice.

Server Hosting Location:

Hosting Location is India.

Data Ownership:

You own content created or stored by You. Use of content by ADSCRM is limited to providing the Service.

User Generated Content:

You are responsible for transmitted or published content. Respect copyright and intellectual property rights. ADSCRM may block or remove content violating rights.

Trademark:

ADSCRM trademarks may not be displayed or used without permission.

Disclaimer of Warranties:

The Service is provided “as-is.” ADSCRM disclaims all warranties, and use is at Your own risk.

Limitation of Liability:

ADSCRM’s liability is limited to a maximum specified amount or the fees paid in the twelve months prior to the liability, whichever is higher.

Indemnification:

You agree to indemnify ADSCRM against losses arising from Your use of the Service in violation of rights or laws.

Governing Law and Jurisdiction:

Any disputes are governed by Indian laws and subject to the exclusive jurisdiction of the Rajkot, Gujarat courts.

Suspension and Termination:

ADSCRM may suspend or terminate accounts for suspected illegal activity, inactivity, or law enforcement requests. Termination on request is also possible.
